Terms and conditions

This document contains the General Terms and Conditions of Contract governing distance purchases of accommodation services made via electronic networks and, therefore, the contract concluded with users of the website belonging to the company Sanpolo S.r.l., with registered office in Borgo Aleandro 8, Motta di Livenza, Italy, in its capacity as owner/manager of the property San Polo Palace 1976, used for short-term tourist rentals / accommodation facilities.

The use of the online booking system available on the official website (https://www.sanpolo1976.com/it) and its booking engine (https://sanpolopalace.kross.travel/) implies full acceptance and application of these General Terms and Conditions. Sanpolo S.r.l. reserves the right to modify these Terms and Conditions at any time without prior notice.

1. Acceptance of the General Terms and Conditions of Sale
By using the online booking service and sending an electronic reservation order, the Client unconditionally accepts and agrees to comply with these General Terms and Conditions, declaring to have read and accepted all provisions contained herein. The Client acknowledges that Sanpolo S.r.l. shall not be bound by any different terms unless expressly agreed upon in writing in advance. The full or partial nullity or invalidity of any article in these General Terms and Conditions shall not affect the validity or effectiveness of the remaining provisions.

2. Commitments of the Client
a. The submission of a booking request implies full knowledge and acceptance of these General Terms and Conditions.

b. Once the online purchase procedure is completed, the Client agrees to print and retain a copy of these Terms and Conditions in compliance with Legislative Decree No. 206/2005 (Italian Consumer Code).

c. To purchase accommodation services from Sanpolo S.r.l., the Client must be at least 18 years of age or legally competent under the laws of their country of citizenship. Reservations completed by minors or legally incapacitated persons shall nonetheless remain fully valid and binding.

3. Purchasing Procedure
a. The website and Booking Engine of San Polo Palace 1976 describe the available accommodation units, applicable rates, services, and special conditions (including terms regarding advance payments, cancellations, etc.). Rates include VAT (unless statutory rate increases occur, in which case the difference shall be charged to the Client) but do not include local taxes, such as the municipal tourist tax (Tassa di Soggiorno), which must be paid directly at the property.

b. The Client shall select their preferred accommodation based on the rates and specific conditions shown at the time of booking. Prior to final confirmation, a summary showing the total cost of the requested services will be presented; the Client must review this summary before proceeding with payment or providing credit card details as a guarantee. Depending on the chosen rate, the Client will be asked to select a payment method (bank transfer, credit card, etc.) or enter credit card details as a guarantee. Upon order submission, the Client will receive a confirmation email containing the booking summary, reservation number, service details, and cancellation terms.

4. Conclusion of the Contract
The contract is finalized upon acceptance of the booking order by San Polo Palace 1976 - Sanpolo S.r.l. The reservation shall be definitively confirmed only upon successful processing of the required payment or authorization of the guarantee credit card. In the absence of successful payment or credit card validation, the reservation shall not be considered finalized and the Client shall have no claim against the management.

5. Exclusion of the Right of Withdrawal
Pursuant to Art. 47 of Legislative Decree No. 206 of 6 September 2005 (Italian Consumer Code), statutory provisions regarding distance contracts, off-premises contracts, and the associated right of withdrawal do not apply to contracts concerning accommodation, transport, catering, or leisure services provided on a specific date or period.

6. Cancellation Penalties and Early Departure
Specific cancellation policies and penalties applicable to the selected rate/unit are detailed on the website and Booking Engine prior to purchase. In the event of early departure, Sanpolo S.r.l. retains the right to charge the full amount of the original reservation.

7. Refunds
Any refunds due to the Client will be processed using the same payment method used for the original purchase, unless otherwise explicitly agreed upon by both parties.

8. Check-in and Check-out Times
Apartments are available from 14:00 (2:00 PM) on the day of arrival and must be vacated by 10:00 AM on the day of departure. Early check-in or late check-out options are subject to availability and may incur additional charges.

9. Special Requests at Booking
Special preferences requested by the Client (e.g., specific floors, double/single beds, adjacent units) are non-binding for Sanpolo S.r.l., which will attempt to fulfill them based on operational availability.

10. Rights and Obligations of the Client
a. Clients with a confirmed and paid reservation have the right to enjoy the booked services in compliance with the property's house rules.

b. The Client must settle all outstanding charges (including extra services and local tourist tax) no later than check-out. The credit card provided as a guarantee may be debited by Sanpolo S.r.l. for any unpaid amounts.

c. The Client is personally responsible for any damage caused to the apartment, fixtures, common areas, or third parties by themselves or their registered guests/visitors.

11. Management Rights
Should the Client refuse to pay amounts due for stay or additional services, Sanpolo S.r.l. reserves the right to charge the credit card provided as a guarantee and to exercise lien rights over the Client's personal belongings present on the premises pursuant to Art. 2760 of the Italian Civil Code.

12. Management Obligations
San Polo Palace 1976 is committed to delivering the confirmed services according to its quality standards. The management reserves the right to assign an alternative accommodation of equal or superior quality in cases of force majeure, unit uninhabitability, unexpected extensions by previous guests, or operational necessity. Any additional costs arising from such replacement shall be borne by Sanpolo S.r.l.

13. Liability for Property and Belongings
Sanpolo S.r.l. is liable for property brought onto the premises by the Client within the limits set by Articles 1783 et seq. of the Italian Civil Code. Management shall not be held liable if damage, deterioration, or loss is caused by the Client's fault, force majeure, or the inherent nature of the items. Storage of hazardous, oversized, or excessively valuable items may be refused. The Client must report any incident to management without unjustified delay pursuant to Art. 1785-ter of the Italian Civil Code.

14. Maintenance
Sanpolo S.r.l. reserves the right to carry out necessary ordinary and extraordinary maintenance work on the properties. During their stay, Clients agree to allow access for urgent repair or maintenance interventions without claiming refunds or indemnities.

15. Pets Policy
Pets are strictly prohibited inside San Polo Palace 1976.

16. Extension of Stay
Extensions of stay are not automatic and must be requested in advance and explicitly confirmed by Sanpolo S.r.l. In cases of objective impossibility to depart due to extraordinary, unforeseeable events (e.g., natural disasters, general transport strikes, authority orders), the stay will be extended solely for the duration of the impediment, applying off-peak season rates.

17. Immediate Contract Termination
Sanpolo S.r.l. reserves the right to terminate the contract immediately if the Client:

Uses the apartment in a manner that causes severe damage to the property or serious disturbance to other guests or neighbors;

Behaves aggressively, offensively, or unlawfully towards staff, management, or other occupants;

Contracts a contagious disease requiring medical measures that cannot be managed within the facility.

In cases where performance becomes impossible due to force majeure (e.g., natural disasters, official orders), Sanpolo S.r.l. may terminate the contract at any time without notice or liability for damages.

18. Complaints
Any complaints regarding the services provided must be reported immediately to management during the stay to allow for prompt resolution.

19. Applicable Law and Competent Jurisdiction
These Terms and Conditions and the legal relationship between the Client and Sanpolo S.r.l. are governed by Italian Law. Any dispute arising in connection with these terms shall be subject to the exclusive jurisdiction of the Court of Treviso (or Venice, based on territorial jurisdiction), subject to mandatory statutory consumer protection laws where applicable.

Authorized personnel: Management, administrative staff, reception, and maintenance/cleaning personnel authorized by Sanpolo S.r.l.

6. Data Retention

Contractual, accounting, and tax records: Stored for 10 years pursuant to statutory requirements.

Police reporting data (Alloggiati Web): Stored solely for the duration of the stay or as required by public security laws.

Contact/booking details: Retained for the duration of the contractual relationship and subsequently as needed for legal defense.

7. Data Transfer outside the EEA
